Welcome to Atomic T-Shirts, LLC (“Atomic T-Shirts,” “we,” “our,” or “us”). These Terms & Conditions (“Terms”) govern your use of our website and services, including purchasing custom apparel and related products. By accessing our website or placing an order, you agree to be bound by these Terms.

 

Please read them carefully.

 

1. Custom Orders & Approvals

Most products we produce are custom-made specifically for you.
Before production begins, you may be required to approve:

• Artwork proofs

• Mockups

• Colors

• Garment types

• Sizes

• Quantities

• Placement of decoration

 

Your approval signifies acceptance of all details.

 

Atomic T-Shirts is not responsible for errors that were present in the approved proof or order details.

Once an order is approved and materials are ordered or production has begun, the order cannot be changed, canceled, or refunded.

 

2. Customer Responsibilities

By placing an order, you confirm that:

• All submitted artwork, logos, and content are accurate

• You have the legal right to use any intellectual property provided

• All garment sizes, quantities, and colors were reviewed before approval

• The contact and shipping information provided is accurate

 

3. Payment Terms

Payment is required before production begins unless otherwise agreed in writing.

We accept various payment methods processed securely through third-party services.

Invoices not paid within agreed terms may incur additional fees, and orders may be delayed or canceled for non-payment.

 

4. Turnaround Times

Turnaround times vary based on:

• Order complexity

• Order size

• Current production schedule

• Availability of inventory

 

We do our best to meet requested deadlines, but turnaround times are estimates, not guarantees.

 

Delays caused by suppliers, shipping carriers, or customer approvals may extend production time.

 

5. Color & Print Variations

Industry standards allow for slight variations in:

• Print placement

• Thread color

• Ink color shades

• Garment dye lots

• Print size (within reasonable tolerance)

 

Such variations do not constitute defects.

6. Industry Standard Spoilage

There is an industry-standard spoilage rate of 1–3% on all custom-decorated orders.

In the event of spoilage:

• For garments purchased from us — we will remake or credit the damaged items.

• For customer-provided garments — we do not replace items, and spoilage is at the customer’s risk.

• Spoiled items beyond the industry tolerance will be addressed by Atomic T-Shirts on a case-by-case basis.

 

7. Customer-Provided Garments

We may accept customer-provided garments at our discretion, with the following conditions:

• We cannot guarantee print or embroidery results due to unknown fabric treatments, blends, or inconsistencies.

• If damage or spoilage occurs, no replacement, refund, or reimbursement is provided for the garment itself.

• We will provide a credit for decoration charges only, not a refund.

This is standard across the custom apparel industry.

 

8. Returns, Refunds & Exchanges

Custom-decorated items are final sale and cannot be returned or exchanged.

Non-custom retail items may be eligible for return under our posted Refund Policy.

If an error is made by Atomic T-Shirts, we will remake or credit the affected portion of the order.

9. Shipping & Delivery

Shipping costs are the responsibility of the customer unless otherwise indicated.

Once the carrier takes possession of the order, Atomic T-Shirts is not responsible for:

• Delays

• Lost packages

• Damage during transit

We will assist in filing carrier claims when necessary.

 

10. Intellectual Property

You represent and warrant that you have the full legal right to use any artwork, logos, graphics, or design elements submitted for your order.

You agree to indemnify and hold Atomic T-Shirts harmless from claims related to copyright, trademark, or intellectual property infringement arising from your submitted content.

All original artwork, designs, and content created by Atomic T-Shirts remain our intellectual property unless explicitly transferred in writing.

 

11. Website Use

You agree not to:

• Use the site for illegal or unauthorized purposes

• Attempt to hack, disrupt, or harm the website

• Use automated tools to extract data

• Reproduce or distribute website content without permission

We may suspend access to customers who misuse the site or violate these Terms.

12. Limitation of Liability

To the fullest extent permitted by law, Atomic T-Shirts shall not be liable for:

• Indirect or incidental damages

• Loss of profits or business interruption

• Errors caused by customer approval or supplied materials

• Delays outside our control (suppliers, shipping carriers, etc.)

Our total liability for any claim is limited to the amount paid for the specific order in dispute.

 

13. Indemnification

You agree to indemnify, defend, and hold harmless Atomic T-Shirts and its employees from any claims, damages, losses, or expenses arising from:

• Use of your submitted artwork

• Misuse of our products

• Violation of these Terms

• Inaccurate information provided in your order

 

14. Governing Law

These Terms are governed by and interpreted under the laws of the State of Texas.

Any disputes will be handled in the appropriate courts located in Texas.

 

15. Updates to Terms

We may update these Terms from time to time.
Updates will be posted on this page with a revised “Last Updated” date.

Continued use of our website or services signifies acceptance of the updated Terms.
